Welcome to AlaCart. These Terms of Service ("Terms") govern your access to and use of the AlaCart mobile application and website (https://alacart.delivery) (collectively, the "Services"). By creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and place orders. By using the Services you represent that you meet this requirement and that the information you provide is accurate and complete.

You may continue browsing as a guest, but an account is required to complete checkout. Notify us immediately at support@alacart.delivery if you suspect unauthorized use of your account.
AlaCart is a marketplace that connects you with independent restaurants and vendors. When you place an order, you authorize us and our payment processor (Stripe) to charge your selected payment method for the order total, including item prices, applicable taxes, delivery fees, service fees, and any gratuity you add.
Authorization holds and re-authorization for your order. When you pay by card, we place an authorization hold for the order total instead of charging you immediately, and we retain that payment method with our payment processor (Stripe) so we can complete your order. Card networks limit how long a hold stays valid — generally up to 7 days, and sometimes less. For a SCHEDULED (advance) order, that hold can approach expiration before your fulfillment date. When you place a scheduled order and authorize it at checkout, you allow us to place a replacement hold on the same payment method for that same order if the original hold is nearing expiration, without further action from you, and to repeat this for as long as that order remains open. A replacement hold is for that order's current total, subject to the limits our payment system enforces; we ultimately charge no more than the final order total and release any amount we don't use. This permission covers only the scheduled order you authorized — it is not permission to charge your payment method for any other purchase, and we do not use it for ASAP orders. Cancellations and refunds are handled as described in Section 5.
Stored payment methods. When you save a card, we store it with Stripe so you can select it for future orders. We only charge a stored card when you place an order with it, or as described above to complete an order you already placed.
Estimated delivery and pickup times are approximate and not guaranteed. You agree to provide an accurate delivery address and any necessary access details. If you are unavailable to receive an order, you may still be charged in full at our discretion.
Cancellation and refund eligibility depends on the status of your order and the policies of the restaurant fulfilling it. If something goes wrong with your order, contact us at support@alacart.delivery and we will work with you and the restaurant to find a fair resolution. Refunds, when issued, are processed to your original payment method.
The Services include community features such as group orders, teams, food drives, donations, and leaderboards. When you participate, you agree to act respectfully and lawfully. Donations and fundraising contributions are voluntary and, unless otherwise stated, non-refundable.

If you join AlaCart as a restaurant or vendor partner, additional partner terms apply to your use of the platform, including obligations relating to menu accuracy, food safety, pricing, and fulfillment. Partners are independent businesses and are not employees or agents of AlaCart.
The Services, including all software, design, text, graphics, and logos, are owned by AlaCart or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that food prepared by restaurants will meet your expectations or dietary requirements.
To the maximum extent permitted by law, AlaCart will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the order giving rise to the claim.
You agree to indemnify and hold harmless AlaCart and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Services or your violation of these Terms.
We may suspend or terminate your access to the Services at any time if you violate these Terms or use the Services in a way that could cause harm to us, other users, or third parties. You may stop using the Services and delete your account at any time.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or on our website with a revised effective date. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the jurisdiction in which AlaCart operates, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
